By accessing and using EchoVote ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your access to and use of EchoVote's website, mobile applications, and services. By using our services, you agree to comply with and be bound by these Terms.

2. Description of Service

EchoVote is a platform that enables:

• Event organizers to create and manage voting competitions
• Participants to vote for contestants using mobile money payments
• Real-time tracking and display of vote counts
• Secure payment processing through mobile money gateways

3. User Accounts

3.1 Account Creation

To use certain features of our platform, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity. You may also terminate your account at any time by contacting us.

4. User Conduct

You agree not to:

• Use the platform for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe upon the rights of others
• Transmit any viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the platform or servers
• Create false or misleading competitions or content
• Manipulate vote counts or engage in fraudulent voting
• Harass, abuse, or harm other users

5. Payments and Refunds

5.1 Payment Processing

All payments are processed through secure third-party mobile money providers. By making a payment, you agree to the terms and conditions of the payment provider.

5.2 Refund Policy

Votes are final and non-refundable once processed. Refunds may be considered only in exceptional circumstances, such as:

• Technical errors on our part that prevented proper vote processing
• Duplicate charges due to system errors
• Fraudulent transactions

Refund requests must be submitted within 30 days of the transaction date. All refund decisions are at our sole discretion.

6. Intellectual Property

6.1 Our Content

All content on the EchoVote platform, including text, graphics, logos, icons, images, and software, is the property of EchoVote or its content suppliers and is protected by copyright and other intellectual property laws.

6.2 User Content

You retain ownership of any content you submit to the platform. However, by submitting content, you grant EchoVote a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content in connection with the platform.

7. Competition Rules

When creating or participating in competitions, you agree to:

• Comply with all applicable laws and regulations
• Ensure all competition content is accurate and not misleading
• Respect the rights of contestants and other participants
• Not engage in vote manipulation or fraudulent activities
• Accept that competition results are final once voting closes

EchoVote reserves the right to remove or modify any competition that violates these Terms or applicable laws.

8. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

• The platform will be uninterrupted, secure, or error-free
• Any defects or errors will be corrected
• The platform is free of viruses or other harmful components
• The results obtained from using the platform will be accurate or reliable

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECHOVOTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM.

Our total liability for any claims arising from your use of the platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless EchoVote, its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the platform, violation of these Terms, or infringement of any rights of another party.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the platform after such modifications constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ghana.
